AI driven expertise & profiling: hype, hope or déjà vu?

May was a busy month. Apart from helping establish then launch a real estate and mortgage business (Bees Homes) I was in Lisboa for Social Now and London for KM Legal UK.

I attended both in the expectation of learning more about the onrush of Artificial Intelligence and its implications for the Knowledge Management profession.

Specifically, I wanted to see how the encouragingly styled Talent and Knowledge Matching / Profiling systems might tackle the challenges of knowledge loss when people depart, of onboarding when people arrive and identifying / ranking expertise that might otherwise be opaque when pulling together teams.

It’s not a new topic: back in the late 90’s I was Business & Strategy Advisor to Sopheon PLC when we acquired Organik (a technology for identifying expertise) and built systems for US Insurers looking to establish the best teams for clients based upon expertise. We never cracked it even though we knew what the issues were (usually motivation)!

Armed with a list of ‘use cases’ I’d worked on with Martin White I set off in search of answers to these questions from both vendors and KM practitioners?

  • Onboarding: A new employee with many years of highly relevant experience joins the firm. How long will it be before their experience is ranked at the same level as their predecessors?
  • Legal: Is the profiling process compatible with the provisions of the General Data Protection Regulation? The thoughts of the Information Commissioner on this are worth a look. Profiling & Automated Decision Making
  • Functionality: Do they offer the ability to present a list of people ranked by expertise?
  • Language: In multinational companies where it is especially difficult to know all the experts, how does the vendor coppe with the fact that documents, meetings and social media traffic will be in local languages?
  • Chinese Walls: How does the application cope with expertise gained on projects that are secure, a common issue in law, finance and R&D where walls need to be erected to prevent commercial information being divulged>
  • Testing: What User Testing is undertaken with a client before signing a contract to verify that the profiling system works?

So, what did I discover? Thierry de Bailllon in his closing Keynote put it very succinctly but with a caveat:

Embrace or die? 88% of technologies already include AI.

it’s not Enterprise Social Networks (ESN)!

This Twitter exchange between Ana Neves and Luis Suarez prompted by a question I posed of the Workplace (Facebook at Work) team following their presentation is revealing:

May 12 Well, I think people are starting to understand how critical it is to know who is who within the org beyond just content, right?

Replying to totally! It surprises me it took so long. It’s amazing the role #ESN can have in unveiling that expertise #SocialNow

On the surface the case for ESN is compelling. Yet the majority of vendors at SocialNow focus on information exchange and conversation rather than the capturing and cataloguing of it. One,@mangoappsinc, had a neat tool (they won the “coolest app” prize) with the ability to upgrade comments from threaded discussions and posts to create ranked knowledge resources from the mass of information and conversation.

So, ESN can show who has answered what question, conduct searches across conversations and in many cases act as a project management tool, the new Facebook at Work (Workplace) now allows the creation of documents for example.

Provided the application is linked to HR systems it is possible to retrieve profiles and see what expertise an individual might have. As one vendor (@OrangeTrail showcasing Facebook at Work)) who uses bots to generate responses put it:

‘Questions’ is the key to find experts as people don’t keep profiles updated.

I concur and they are great facilitation platforms though with advanced features that will suffice for many. Yet I left Lisboa though feeling organisations will need to rely on assisted search for some time if they want to take a deep dive into expertise

So onto London and KM Legal UK. An interesting Day One ended with a psuedo Peer Assist in which AI was raised a lot.

One observation (facilitation tip): the session failed to commit the ‘owner’ of the problem to action so as a result the feedback loop to plenary became a series of “we said this.”

Again, as in previous years I felt the focus was on operational tools and techniques which means that KIM Professionals in Legal are more at risk from the onrush of technology.

It reminded me of the issue Librarians faced with the arrival of end user search in the mid 90’s which finished their monopoly of being the people who found stuff in organisations.

Day Two took a deeper dive into technology and its potential impact.

I tweeted having heard Cliff Fluet’s excellent presentation:

And I questioned:

How wide is scope of AI? More than Doc Analysis / Creation. Opportunity to broaden knowledge base

As yet no one had focused on expertise and profiling so when one presenter cited the case where a newly arrived CEO asked the Head of HR / Talent Management to let him have profiles / competencies of the staff using their system it got my attention.

I asked whether the results the HR head gave the CEO inferred a level of expertise. It didn’t which got thinking that if the data set is incomplete and the issue of self reinforcing bias is not addressed then over reliance on one source for identifying ‘experts’ is dangerous. Imagine your career prospects if for whatever reason your name wasn’t on the ‘expert’ list given to the CEO?

So where do I see the state of expertise and profiling systems? Patchy!

Yes there are certainly companies who ‘get it’ but can they do it?

I am indebted here to Martin White who in an excellent report “People and expertise seeking – an overview” summarises the predicament thus:

The most important lesson learned is the need for an expertise location strategy that is linked into HR processes, knowledge management, training, job appraisals and social media development. Finding people with expertise is not a ‘search problem’.  Good search tools can certainly help but without attention being paid to profile quality (even if other types of content are being searched) and a commitment by employees to share their knowledge expertise discovery will not be as successful as anticipated or required.

My takeaways:

  • KIM professionals need a clear strategy (working in partnership with other stakeholders such as HR and IT) and be clear on the questions being solved by any system;
  • They need to be clear what they are getting, what’s missing and how it mitigates the potential for self reinforcing bias when they enter discussions with vendors around automating expertise seeking and profiling;
  • They need to recognise the importance of their role in facilitating the adoption of such systems and accept this is just a part of a portfolio of approaches of identifying, capturing and retaining expertise;
  • They need to be clear what critical knowledge actually is in their organisation and who is likely to have it in order to assess the veracity of the results of any pilot;
  • It doesn’t matter what solution you adopt, if your environment is not conducive to the sharing of expertise and people don’t see the value in it then save the money; and
  • In any event you cannot capture everything people know; we learn and share through stories (failures rather than successes) and those often remain hidden.

Overcoming the “How can I ask without looking silly?” barrier: KM Legal Europe

January in Amsterdam has become a bit of a tradition as is leading the opening session at KM Legal Europe.

My brief was to replicate 2016 and provide a stimulating opening. I was delighted with the enthusiastic response and the level of interaction that occured over the two days expertly led again by Chair Raffael Büchi.

So what did I see and hear (and learn), and where is Legal KM one year on?

What trends did I see?

The ‘big’ trends for me were:

  • A headlong rush into document automation. “Automating the drafting of legal documents” = intelligent workflow with knowledge embedded that reduces duplication and saves time. 50% of the room said their organisation was engaged in some form of document automation. And its easy to see why its appealing. One statistic that was shared: a saving of 200 lawyer hours a month from 1,150 templates automated. Interestingly this presents a great opportunity for KM’ers with Document Automation installaton experience. Not enough experience vs. too many installations. Importantly another value of Doc Auto: Training young lawers – gets them up to speed quicker as questions it poses makes them understand.
  • The ongoing challenge of getting adoption for the plethora of KM related initiatives: As one speaker suggested, the key is getting them set up yourself f2f. Don’t subcontract to IT. And ‘Celebrate’ use. Communication needs a good narrative to motivate people and get engagment. F2F meetings vital. Brand it as your product; Use advocates (Butterfly effect); Get testimonials.
  • How often reporting lines change for KM’ers as their sponsor moves on. Few I spoke to were on the Managing Committee, many had seen their sponsorship downgraded.

What surprised me?

  • The ease with which all the delegates (many in suits) enthusiastically engaged with the opening exercise I ran and were suprisingly open and candid about “what do you bring to the event?” and “what are the big issues you are facing and would like an answer to?”

  • That despite the promotional hype, machine learning engines still require a lot of manual input upfront from people with domain knowledge to get started which is why there is a growth in companies offering to do the setup work. Need to have engaged partner to drive document automation yet some lawyers enjoy drafting docs – issue: WIIFM (What’s in it for me?) is not addressed.
  • That some firms really get the value of KM. European Law Firm of Year; Swiss Law Firm of Year, UK Law Firm of Year. A Common thread? All have KM Heads who are attending the event. The European Law Firm of the Year had a Senior Partner, the Partner responsible for KM and the KM Head. They are one of few firms to have adopted ISO 9001 Quality Management -realised needed something to unify disparate offices and integrate aquisitions. The dna of the firm: based around the Practice Management System their default system (CRM plus) containing a body of knowledge on the Baltic region which can be put to multiple uses for the firm. It also serves as a timesheet for billable time. Challenge is how to replace so they embarked on a firm wide stakeholder engagement to produce a requirements specification. Note it was not seen as an IT Project!
  • The way in which the dynamic / energy changes at an event when it reverts to “Show and Tell” vs “Ask and Share” The lesson those engaged in the creating and running of events like this took away was that you need people energised from the ‘get go’ each day.
  • That many thought you could engage in Knowledge Capture via forms and macros. As I tweeted: My great fear – you don’t get critical knowledge captured by completing a form – you need to do it around events and in person!
  • That Data Breaches have become a way of life – firms need process for dealing with them as penalties are punitive.

One revealing survey result from Lawyers: “How can I ask without looking silly?” – loss of face is a real barrier to adoptiion!

Adoption Tips for Sceptics: Articulate savings; Flatter Rocket Scientists and invite contributions; Ignore unbelievers who often turn when others are doing it and they feel peer pressure to join them.

Knowhow management is not a “ding an sich”, separated from other business functns. It’s just a regular part of good management.

 

What advice would I give Legal KM’ers?

  • Your role will involve more Curation and Facilitiation (2 of the 8 ‘ates I talk about elsewhere in describing the future role of the ‘Knowledgeur’) as the need to consolidate corporate knowledge becomes increasingly digital. Tools should be based on the strategic direction of the firm; learning (not training) sessions ensure people are versed in their use. But don’t forget one of the most important KM tools is Coffee – one new KM leader had 420 coffees in first couple of months!
  • Don’t be afraid to use external speakers to stimulate an in house response and introduce an element of competition. Round table cafes are successful in Switzerland – over food!
  • Embrace technology as it’s here to stay. Where possible use the systems already in house. Develop practice groups to help produce requirements specifications. And make sure you are clear the role each tool is playing.
  • You can achieve a lot with a little. Real change is often simple and inexpensive. In one example the PA’s wanted a practice group to organise calendars and email traffic and Intranet needed quick links. Both were low level but effective and resulted in improved productivity. Where possible use the systems already in house.
  • Be opportunistic: A Good KM /comms /engagement. The Brexit vote gave impetus to a “Hot Topic” project in one firm. By consolidating all that was known and equipping lawyers with answers the profile of the team rose. Learning: people like getting together to discuss topics.
  • KM Legal needs to be closely aligned with Learning & Development and HR. One firm developed a 1 week corporate program (mini MBA) that included KM focused on competency gaps. Their KM Committee reports straight to Managing Partner. It has teeth and includes core functions of the business.
  • Develop a suite of simple facilitation tools and techniques: One firms uses POSE acronym to drive all meetings: Purpose / Owner / Safety / Engagement. I’ve often used DEBRIEFS.
  • Become part of the business development process: Many firms now see KM involvement as important to winning new business or as part of the broader service offering.

And finally:

I see this as being an evolution rather than a revolution. We are at Stage 3.

Stage 1 Search: Making documents, images and audio/video available and tagged;

Stage 2 Review & Connect: Analyse/summarise documents, images & audio/video push to relevant people. Identify patterns, connect; and

Stage 3 Predict & Facilitate: Using raft of data, information & accumulated knowledge to predict likely outcome & facilitate

One of the real highlights was that 20 people joined me for an impromptu conference dinner at a nearby Pho Vietnamese Restaurant. It reinforced the importance of food and drink in being lubricants for great conversations.

I took away a feeling that this question is still not being addressed satisfactorily and that firms remain at risk when people and teams leave or are acquired:

The risk of critical knowledge loss is not just about what people know, its about who they know and what networks they might know.

Perhaps AI will help in consolidating the know how of firms and hence build resilience into their models which remain vulnerable if people (and teams leave). Certainly the approach being adopted by the European Law Firm of the year of integrating CRM and workflow with precedents and transaction management is a bold step. Only time will tell if its successful and becomes the blueprint.

Future of the Internet and Legal KIM in an artificial world

It started at Chatham House and a fascinating discussion held “on the record” on the future role of the Internet (“the most important infrastructure in the world”) prompted by a report from a very well qualifiied group of 28 experts led by former Swedish Prime Minister Carl Bildt.

This quote from their report targeted at public policy makers caught my eye:

The Internet has connected more than three billion people in just a few decades, however, over half of the world’s population remains off-line. If the rest of humanity is not given the opportunity to come online, digital and physical divides both within and between societies will widen, locking some into a permanent cycle of exclusion from an increasingly digital global economy.

Countries cannot hope to compete in the global marketplace of ideas if their business communities and broader populations are not online.

One Internet can be found here. Distributed under a creative commons licence Its worth a read. A few of my many takeaways from yesterday’s event:

  • Internet is in danger of becoming the ‘splinternet’ as governments seek to improve cybersecurity and restrict who can access what
  • Cybersecurity wears many hats. In totalitarian regimes it means controlling access to what is considered ‘destabilising’ and salacious material not merely espionage
  • False news is on the rise underpinned by the self reinforcing bias of Social Media sites (more on this later)
  • The role of educators is vital to equip tomorrow’s workforce to be digitally literate (see Arab Times article by Dana Winner for more on initiatives in Kuwait)
  • “Its the end of the industrial age and the beginning of the digital age” and “we are coming to the point of contraction” (Quotes from Dame Wendy Hall)

2017 Legal KM Objectives

This very nicely set up the afternoon’s video session at Ark Group ahead of the forthcoming KM Legal Europe Conference in Amsterdam.  I was asked half a dozen questions. Here I will focus on:

What do you think are the key challenges facing knowledge managers in law firms specifically right now?

To answer this I approached two dozen practitioners and thought leaders in Legal KM last Thursday. I used LinkedIn for some and a personal direct email for others. I received 14 responses within a day a response rate for which I am extremely grateful.

Here is a truncated snapshot of the responses (my groupings) with anonymity preserved:

How to maintain lateral and peripheral vision towards the business goals, where their area of practice fits in to the greater perspective at hand. What can be done daily, weekly, monthly, to take time to do this, when their entire perspective is tied to billing in 6 minute increments, tied to AFA agreements built on efficiency and transparency geared towards the client and their practice area billing requirements? Measuring ROI on client relationship development activities – i.e. not winning new clients, but deepening existing relationships

Getting engagement from fee earners as they struggle to meet their chargeable targets

 

How can knowledge (in widest sense) help firms deliver on the more for less agenda, both internally and to clients?

Preserving client-lawyer face-time, trust and intimacy in a time of online communication

How to better share knowledge with our clients (meaning the clients of the firm)?

 

Understanding how to harness the power of AI in the business:

– to what / where is it best applied?

– is there a first mover advantage or should we wait, learn from innovators’ mistakes and leapfrog with v2.0?

Platforms for commodity work, Artificial Intelligence in all its form, Block chain, Big Data. It is hard to keep up and very unpredictable what it will bring and how it will change the legal business

Move from paper sources and library towards a digital Knowledge Centre, while trying to cope with the increasing information overload. Disruption of legal services

Horizon scanning for us and for our clients.

 

Untangling the appalling hype and confusion about AI

A few stood out (some strategic, some operational): act or wait (in relation to AI); responding to a change in regulation; creating a Digital Knowledge Centre (will AI make that obsolete?); and how to resolve the difficult challenge of preserving client-lawyer relationship when technology makes advice more of a commodity.

You will note how often AI comes up in the 2017 objectives. This is the question I was asked:

Everyone is talking about artificial intelligence (AI) in the legal sector right now. How do you think AI can really boost efforts to better manage knowledge within a firm?

Many books have already been written on this topic and thousands of articles. Its the new nirvana. Even though AI has the potential to lower barriers to entry have we been there before? Not according to Professor Mohanbir Sawhney in an excellent article in  September’s Harvard Business Review entitled Putting Products into Services he argues:

…By leveraging the power of algorithm-driven automation and data analytics to “productize” aspects of their work, a number of innovative firms are finding that, like Google and Adobe, they can increase margins as they grow, while giving clients better service at prices that competitors can’t match. Productivity rises, efficiencies increase, and nonlinear scale becomes feasible as productized services take over high-volume tasks and aid judgment-driven processes. That frees up well-paid professionals to focus on jobs that require more sophistication—and generate greater value for the company.

I see this as being an evolution rather than a revolution. We are at stage 3:

  1. Stage 1 Search: Making documents, images and audio/video available and tagged
  2. Stage 2 Review & Connect: Analysing and summarising documents, images and audio/video and pushing to relevant people. Identifying patterns and making connections.
  3. Stage 3 Predict & Facilitate: Using the raft of data, information and accumulated knowledge to predict what the likely outcome of an event or series of events might be and to then help facilitate those outcomes.

If you accept that 80% of a company’s data is unstructured there is ample scope. So what options do firms have?

  • Partner
  • Build
  • Buy (or rent)

Some of the biggest firms have already moved forward: Dentons has gone down the partner route investing in Next Law Labs and acting as a test bed for their ideas; Pinsent Masons have opted to build their own, a do it yourself AI called TermFrame; Linklaters signed up to buy/rent from RAVN and in a really interesting move Cotswold Barristers have become ‘barristers direct’ marketing their fixed fee services to potential claimants.

What’s interesting is how well represented the UK is in the AI field and how many of the emerging businesses can be found around City Road in Tech City, London.

Yet despite the hype AI has a chequered recent history:

  • Both the US Presidential Elections and Brexit Referendum were called the wrong way
  • The challenge of the self reinforcing bias is not met which makes outcomes susceptible to false news and accentuates the Prism Effect
  • Humans are still needed for interpretation, managing of networks and facilitation of outcomes.

and finally

I am going to draw on two quotes from the respondents (both highly visible and respected Legal Professionals who find themselves in roles that have KM components):

AI and automation models if put in place successfully would augment the journalists*, augment the attorneys, make them more successful for themselves, the client, and the business.

*This was in reference to a John Oliver sketch on US TV about the impact AI is having on journalism. See Chicago Tribune summary here.

The rise of newer forms of technology is challenging the way codified knowledge is managed leading to the need for KM professionals to work with new types of colleagues such as business process improvement specialists and AI providers.

Today DeepMinds and Royal Free Hospital’s App is launched. It is a great example of how data can be analysed and outcomes presented to the clinician for recommended treatments. Substitute the Lawyer for the Clinician and it’s clear similar search, retrieval and analysis tools might be used in Legal.  See here for more.

‘Probably the best PKM in the world’: KMUK 2016 uncovered

It’s conference season which means I get to go to nice places and meet and learn from interesting people. This week I was in London for the annual Knowledge Management UK event and a cracking good couple of days it turned out to be.

IMG_4774Well attended by 60 or so KIM professionals, it was chaired by Ian Rodwell @Irodwell of Linklaters who I’d recommended and who did me and Laura Brooke of Ark @LauraAtArk, proud.

From the ice breaker opener onwards Ian’s touch was light but assured and the delegates all participated with enthusiasm.

What surprised me?

  • I got something out of every presentation which might sound a bit arrogant but when you’ve been to many KM events there are usually a couple that don’t quite cut it. This time each speaker slotted in well with the next and the event flowed.
  • The number of KM ‘Veterans’ attending for the first time in a long while commenting how lonely the role can be (whatever it’s called) and how durable KM’ers have to be.
  • IMG_4786Learning that the Govt’s 5 year Knowledge & Information Strategy (GKIS) produced in 2013 is still not published and unlikely to see the light of day.  Yet work is still going on as David Smith explained to create career pathways for the cadre of professionals who comprise the civil service’s Knowledge & Information Management profession. I didn’t get the feeling that CILIP are integral to those competency framework discussions which is a missed opportunity on both sides as there is no current industry group that effectively represent the KIM global profession as does a CMI or CIPD in Marketing or Human Resources (Personnel).
  • Discovering that the average age of people in E&Y is 27 (hence generation Z to the fore). E&Y’s big challenge for is to move from a vertical to horizontal communications and employee engagement approach. Their Communities of Practice / Skills are a great way of cutting across silos.
  • Despite all the ballyhoo around technology search is still not cutting it for most and my recent musings on the continued need for Assisted Search valid.

What intrigued me?

  • The session on Artificial Intelligence (AI) whcih included the suggestion that it is ‘parked on the lawn’ of call centres and people who have to read long books for a living and are also engaged in risk management. Today AI does not do emotional intellience very well but that is changing despite reservations about the ethics of it.  Linklaters are a good example of an organisation experimenting with AI to improve efficientcy.
  • Nick Milton’s @nickknoco thoughts on adopting the 7 step Lean Model for a KM programme and the wastes of KM supply chain: excess production, delay, too many steps, excess hand-offs, defects etc.  By a strange coincidence 7 came up in my presentation when I talked about the 7 ‘ates of a Knowledgeur. A separate blog will be forthcoming to coincide with my address to the CILIP annual Confrence in three weeks time.

What delighted me?

  • IMG_4785Christopher Payne’s @cjapayne excellent account of the Knowledge Management effort that is embedded in the Olympics.  It is the most visible of all Project KM programmes (see alongside) with great potential to act as a benchmark for all big cross border multinational projects. Imagine the expertise they have developed (with quite a small team) in transferring knowledge from London to Rio to Tokyo all in the gaze of the global public. I know Chris is keen to share his IMG_4787knowledge with the greater KM community so contact him or hear him speak.
  • TfL’s approach outlined by @LemmerLutz to making great use of Lessons Learned and feeding improvements back into process.  The graph alongside illustrates the successful postings of lessons to their KM portal (up nearly 300% in 2 years).
  • The broad acceptance that you can achieve a lot with a little.  The Financial Conduct Authority presentation being a great example of how to make effective use IMG_4790of people by using communities and having an easily understood framework. I noted though that poor search is a real barrier to adoption and that the lack of a technical underpinning a constraint.
  • Hearing from a couple of people how Random Coffee Sessions can be effective. The idea is simple: develop a list of people who are interested in having short coffee meetings with peers on a 1:1 basis and pair them up on a periodic basis.

What frustrated me

  • The continued reluctance to share thoughts / observations on Twitter, a stance at odds with the audience’s oft stated desire to ‘Work out Loud”.  How can you encourage others to do so if you don’t do it yourself?  I wrote more on this subject a year back coining this phrase: It was like throwing a dart into a vacuum.

What did I not hear I expected to?

  • Social Network Analysis: Despite a real focus on Communities Social Network Analysis was not discussed. Not knowing who people go to for answers or who knows what is a risk to many businesses if those key but often hidden people depart. To a large extent the risk from the sudden departure of the ‘Expert’ is diminishing with the rise of empowered and informed knowledge workers and processes that contain embedded knowledge.

The rise of Legal ‘Lean’ and its impact on Knowledge Management: looking back at KM Legal Europe 2016

IMG_4381A year on from the Breakfast Breakout Martin White and I ran for Legal Knowledge & Information Management professionals in London I found myself back among them in Amsterdam at KM Legal Europe.

My brief was to provide a stimulating opening to the conference (I went with In at the Deep End – an Icebreaker I used at KMUK) and then give a presentation on the second day on Working Virtually. I was delighted with the enthusiastic response and the level of interaction that occured over the two days expertly led by Chairman Raffael Büchi.

So what did I see and hear (and learn), and where is Legal KM a year on?

Who or What’s driving KM in the Legal Sector?

Firstly, clients are becoming more sophisticated and insisting law firms are better. And new offshore firms are emerging that are making legal advice more a commodity product that can be disintermediated through technology. That’s having a knock on effect as firms bow to pressure for greater transparency, more efficient processes and better use of technology.

Some firms have also recognised the risk arising from the potential loss of knowledge when people and teams leave or the need to do more effective due diligence on the knowledge they are acquiring when people and teams join.

They are responding by ‘offshoring’, adopting established process improvement methodologies such as Lean/Six Sigma and integrating that into continuous proces improvement,  combining CRM with EDRM, building Legal Project Management capability,  attempting to get into their client’s shoes and using horizon scanning to take a look at the future.

From a Quality & Standards perspective, ISO 9001 certified firms and their Quality Managers are also casting a watchful eye on the emergent standards having noted the introduction of the amended regulations in September 2015 which for the first time made mention of Knowledge Management (Clause 7.1.6. Knowledge) noting: “The concept of organizational knowledge introduced to ensure the organization acquires and maintains the necessary knowledge”

The early KM adopters on dsplay in Amsterdam had visionary leadership to thank for embarking on their initiative, their challenge is sustainability when their sponsor departs.

These categories I find useful as a way of identifying the drivers behind a KM initiative:

  • Innovation / Process Efficiency
  • Risk Management
  • Quality & Standards
  • Vision

What trends did I see?

The ‘big’ trends for me were:

  • Rise of Continuous Process Improvment initiatives supported by Process Mapping and Automated Document Assembly,
  • Increasing use of Predictive Analytics “law has talked billable hours for ever. Clients using Artifical intelligenceI to cross check time sheets and identify duplicate effort”
  • A recognition that billable time can be apportioned to KM related activites. I noted, “big change happens when lawyers can charge billable hours while working on KM. some tried contributor of the month rewards.”

What surprised me?

The number of partners who are known as Knowledge Partners which illustrates a career path now for Legal KM’ers.

We use Social Media to recruit but not to collaborate. In a good open discussion it was clear that the majority were sceptical about using Social Tools citing confidentiality. I was drawn to this comment from Erik Hunter who in his opening to Day Two encouraged the audience to: “think about the science of social media, the thoughts behind it, not just as push tools for comms & sales.

Offshoring – where is my knowledge? Few of the people I spoke to had considered or made attempts to mitigate the risk of knowledge loss from outsourcing operational activitives.

The idea of a “call outs for know how” by the KM team. A tailored process based on deal flow. Looking for nuggets from across the firm.

The establishment of a Corporate University in a legal firm who have a competency framework that includes a metric of min 50 hours per year commitment to KM.

Continuous Process Improvement supported by Enterprise Search that can look across Matters Directories.

Despite recognising the importance of good project management training for the changing world the training was described as being too generic.

What advice would I give Legal KM’ers?

  • Fix something for someone quickly.” A great quote from a panel session to which I’d add, focus on a maximum of 3 issues, adopt a pilot approach and show results in first 6 months.
  • Embrace the ‘Barbarians at the Gate‘: Legal KM’ers are getting their accreditation as Green or Black Belts. KM’ers have the facilitation skills needed to get lawyers to do process mapping and need to learn the language and practices of Lean / Continuous Process Improvement supported by Enterprise Search or change the dialogue at the senior level so that KM interventions are embedded into process. I noted: “continuous improvement can reinvigorate KM importance of process maps and fishbone diagrams” from a session by Arjan Krans.
  • You need to be seen as a contributor to the delivery of the service to the client: During one of the sessions looking at turnover this statement was made: “Knowledge teams tend to be stable in Law firms”  prompting this question ‘Why?”  The reply: ‘A KM role is lifestyle decision with predictable time”.  The point was made that Legal KM’ers are less inclined to do the unsocial hours associated with Lawyers. In plenary I made the point that in all organisations those who are seen as ‘support’ or ‘operational’ rarely get the recognition rain makers do.
  • Become skilled at facilitating virtual meetings and collaboration. Communities (inwards and outwards) will continue to grow in importance. Firms are not spending enough equipping people with the social skills to make virtual encounters work effectively.
  • Get in front of the client. A quote that really struck home. A lawyer was asked if he had run the proposed Application past the prospective client base. His response: “No I have a clear ideal of what they want.”
  • ‘Get the squeaky wheels on side’.  Have a One Pager (preferably with a visual) that summarises what you do (and don’t) do.
  • “We (legal) use scattergun approach to sharing knowledge. Use social media or die!” Nicky Leijtens

I heard this from the two legal counsels pleading for a change in the way the client / firm dynamic works: “collaborate not push, it starts to rain newsletters all of which are the same”.”Clients don’t want exclusive portals with law firms. Don’t think me & my client, think in terms of communities”

Law firms need to ensure the knowledge circulated and shared w/ clients differentiates, distinguishes & sets them apart.
